Privacy Policy
Statement of Need and Definition
First National Bank offers a wide array of products to meet the financial needs of our customers. While meeting those needs it is necessary to obtain personal information from the customer. This policy for Privacy of Consumer Financial Information of the Bank has been developed to comply with various sections of the Gramm-Leach-Bliley Act.
Purpose
In meeting the needs of our customers, First National Bank will offer products where personal information is gathered. The purpose of this policy is to comply with the treatment of nonpublic personal information gathered by First National Bank, and our commitment to the confidentiality in the disclosure of that information to third parties. The privacy of information is important for all our customers. We collect, retain, and use information about individual customers only where it will be useful to administering our business and to provide products, services and other opportunities to serve our customer.
Objective
The objective of this policy is to let our customers know what we do with the nonpublic information that we collect. This policy will be subject to review, and changes made to meet changes in the law.
Responsibility and Administration
The Board of Directors shall be responsible for the approval of this policy and reviewing it on an annual basis. The executive management of the Bank shall oversee this Policy and assure the board of directors that it is being adhered to. All officers and employees shall follow this policy as set out below.
Definitions
Affiliate means a company we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control.
Non-Public Personal Information means information about you that we collect in connection with providing a financial product or service to you. Non-public information does not include information that is available from public sources such as telephone directories or government records.
Information Collected
As a financial institution, the Bank maintains information about our customers. This information includes some items that we could not obtain from anyone else but our customer. This information helps us to develop products, to provide the financial services that are needed and requested, and to respond to changes in technology.
The Bank will provide a Privacy Notice before entering into each new customer relationship for personal, family or household purposes and annually for as long as the relationship continues.
The Bank collects nonpublic personal information from the following sources:
- Information we receive on applications and other forms
- Information about transactions with us
- Information from consumer reporting agencies
- Information about your transactions with non-affiliated third parties
Some information is gathered to comply with laws and regulations (for example: we must get a social security number to report interest earned, as well as interest paid). Some other information is taken to maintain the security of accounts (such as a mother's maiden name), which helps us ensure that nonpublic personal information is not given to an unauthorized person.
Sharing Customer Information
Privacy is important to us, and because of that, we do not disclose any nonpublic personal information about our customers, except as permitted by law. Some examples of who we are required to share nonpublic personal information with are: regulatory authorities (like bank examiners), or when we are served with a properly executed subpoena or court order. As is the case with other financial institutions, we share information with reputable credit reporting agencies, as authorized by federal law. Any other information we share with others will only be done as is lawfully permitted. We do not disclose information about former customers, except as permitted by law.
We may disclose all of the information that we collect, as described above, to companies that perform marketing services on our behalf, or to other financial institutions with which we have a joint marketing agreement.
Employee Access to Information
All of our employees are made aware that personal information is confidential. Their responsibility is to keep information out of the hands of anyone that is not authorized to access that information. This issue is addressed in the Employee Personnel Policy and is an important part of orientation for new employees. Employees are asked to sign an acknowledgement that they have read and will adhere to this policy. In addition, employees will receive specific privacy training and communications on an ongoing basis. We restrict access to nonpublic personal information to those employees who need to have access to this information to provide products and services to customers.
Information Protection
First National Bank is committed to the security of financial and personal information. We maintain physical, electronic, and procedural safeguards to protect nonpublic personal information and allow access only in accordance with Federal and State laws and regulations and our internal security standards.
Should an account close or become inactive, the information that we share will be the same as if the customer relationship still existed.
